Terms of service
Welcome to Dodo Paws.
Welcome to Dodo Paws. Dodo Paws is operated by FERRONET METAL TRADE LTD. Dodo Paws operates this website and provides all related information, content, features, tools, products and services (the “Services”).
We operate www.dodopaws.com and provide the information, content, features, tools, products and services available through the website (collectively, the “Services”).
By accessing or using the Services, or by placing an order with us, you agree to these Terms of Service together with our Privacy Policy, Returns & Refund Policy, and any other policies made available on the Site.
If you do not agree with these Terms, please do not use the Services.
Nothing in these Terms excludes, restricts or modifies any mandatory consumer rights that cannot lawfully be excluded under the laws applicable to you.
1. Eligibility and Accounts
You must be at least the age of majority in your country or region of residence to use the Services or place an order.
You agree to provide accurate, current and complete information when required, including your:
- contact information;
- billing information;
- payment information;
- shipping information.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
Accounts may not be transferred or assigned to another person without our permission.
2. Our Products
Dodo Paws sells products and accessories primarily intended for pets and pet owners.
We make reasonable efforts to display product descriptions, dimensions, colours, materials, photographs and other information accurately.
However, colours and appearance may vary depending on your screen, device settings, lighting or manufacturing variations.
Where dimensions or measurements are provided, please review them carefully before ordering, particularly for products such as pet beds, accessories, clothing or size-dependent products.
Product descriptions, availability and specifications may be updated from time to time.
We may discontinue products or limit their availability in certain countries or regions.
Nothing in this section limits any rights you may have where a product does not match its description or otherwise fails to comply with applicable consumer law.
3. Pet Product Use and Safety
Products should be used according to their intended purpose and any instructions supplied with them.
Customers are responsible for selecting products appropriate for their pet's size, age and individual needs.
Where appropriate, pets should be supervised while using products, particularly products that may be chewed, damaged or contain small components.
Regularly inspect pet products for wear or damage and discontinue use if a product becomes unsafe.
Information available through Dodo Paws is provided for general product information and is not intended to replace professional veterinary advice.
Nothing in this section excludes or limits any mandatory consumer or product-safety rights.
4. Orders
Placing an order constitutes an offer to purchase the selected products.
We reserve the right, where legally permitted, to refuse or cancel an order for legitimate reasons, including:
- product unavailability;
- suspected fraud;
- payment failure;
- incorrect product or pricing information;
- shipping restrictions;
- manifest technical errors.
If we cancel an order after payment has been received, the relevant amount will be refunded.
Please carefully review your:
- product;
- size or variant;
- quantity;
- delivery address;
- contact details
before completing your purchase.
Because fulfilment may begin shortly after an order is placed, amendments or cancellations may not always be possible once processing has begun.
Returns and refunds are governed by our Returns & Refund Policy and applicable consumer law.
5. Prices, Payments and Taxes
Prices and promotions may change from time to time.
The price applicable to your purchase is the price shown when your order is placed, subject to correction of manifest errors where permitted by law.
We aim to present prices and applicable charges clearly before you complete your purchase.
Any applicable shipping charges, taxes, duties or other charges will be displayed or disclosed where required by applicable law.
International orders may in some circumstances be subject to customs duties, import taxes or other charges imposed by the destination country.
Where such charges are the customer's responsibility, this will be subject to applicable law and the information provided during the purchasing process.
You agree to provide accurate and authorised payment information.
For Australian customers, businesses must communicate clear and accurate prices and must not mislead consumers about what they will be charged.
6. Shipping and Delivery
Products may be shipped by Dodo Paws, third-party suppliers, fulfilment partners or logistics providers.
Some products may be shipped directly from an international fulfilment location.
Shipping and delivery estimates are estimates only unless expressly stated otherwise or required by applicable law.
Delivery times may be affected by circumstances outside our reasonable control, including:
- customs procedures;
- carrier delays;
- weather;
- public holidays;
- transportation disruptions;
- incorrect delivery information.
We will make reasonable efforts to assist customers if an order is significantly delayed, damaged in transit or not delivered.
Risk of loss and responsibility for delivery will be determined in accordance with applicable consumer law.
Nothing in these Terms limits your rights where products you have paid for are not supplied or delivered as required by applicable law.
7. Australian Consumer Rights
If you purchase products as a consumer in Australia, your purchase may be protected by the Australian Consumer Law (ACL).
Consumer guarantees under the ACL apply automatically and cannot be removed by store policies or contractual terms.
These guarantees can include requirements that products:
- are of acceptable quality;
- are safe and free from defects;
- match their description;
- are fit for their intended purpose where applicable.
If a product fails to meet an applicable consumer guarantee, you may be entitled to a remedy such as repair, replacement, refund or compensation depending on the circumstances.
Importantly, the ACCC states that when an overseas business sells products directly to consumers in Australia, it must comply with the Australian Consumer Law, including consumer guarantees.
Nothing in these Terms or our Returns & Refund Policy is intended to exclude these rights.
8. Returns, Refunds and Cancellations
Returns, refunds and voluntary change-of-mind returns are governed by our Returns & Refund Policy.
Any voluntary return period offered by Dodo Paws is in addition to, and does not replace, mandatory consumer rights available under applicable law.
In particular, a voluntary 14-day return period does not impose a 14-day limit on statutory rights relating to faulty or non-compliant goods.
The ACCC confirms that consumer guarantees continue for a reasonable period depending on the product and cannot simply be removed by an arbitrary store warranty or return period.
9. Intellectual Property
Unless otherwise stated, the Site and its content, including:
- text;
- graphics;
- photographs;
- videos;
- logos;
- branding;
- website design;
- product presentation
are owned by or licensed to Dodo Paws, FERRONET METAL TRADE LTD or their respective licensors.
You may use the Site for personal and non-commercial purposes.
You may not reproduce, distribute, modify, sell or commercially exploit protected content without appropriate authorisation.
10. Third-Party Tools and Services
Our Services may use or integrate third-party platforms, applications, payment providers, fulfilment services, analytics services, social networks and other technologies.
Your use of certain third-party services may also be subject to the terms and privacy policies of those providers.
We are not responsible for third-party services to the extent permitted by applicable law.
11. External Links
Our Site may contain links to third-party websites or services.
We do not control those websites and are not responsible for their content, availability, security or privacy practices.
You should review the applicable terms and privacy policies before using third-party websites.
12. Reviews and User Content
If you submit a review, photograph, comment, suggestion or other content to Dodo Paws (“User Content”), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and distribute that content in connection with our Services and marketing, subject to applicable law.
You confirm that you have the necessary rights to provide such content and that it does not unlawfully infringe the rights of another person.
We may remove content that is unlawful, misleading, abusive, fraudulent or infringes third-party rights.
13. Errors and Corrections
Despite reasonable efforts, occasional errors relating to:
- product descriptions;
- prices;
- promotions;
- availability;
- specifications;
- delivery information
may occur.
We may correct genuine errors and update information.
Where an error affects an order already placed, we will act in accordance with applicable consumer law, including providing an appropriate refund where required.
14. Prohibited Uses
You must not use the Services to:
- violate applicable laws;
- infringe intellectual property or other rights;
- distribute malware, viruses or harmful code;
- send spam;
- attempt unauthorised access to our systems;
- interfere with the security or operation of the Site;
- fraudulently obtain products or services;
- unlawfully collect personal information;
- engage in abusive, fraudulent or malicious activity.
We may restrict or terminate access where reasonably necessary to protect the Services, our customers or our legal rights.
15. Suspension and Termination
We may suspend or terminate access to the Services if these Terms are materially violated or where reasonably necessary for security, fraud prevention or legal compliance.
Provisions which by their nature should continue after termination will remain effective.
16. Disclaimer
We make reasonable efforts to operate the Services reliably and accurately.
However, to the maximum extent permitted by law, we do not guarantee that the website will always be uninterrupted, error-free or available.
Nothing in this section excludes any guarantee, warranty, condition or right that cannot legally be excluded.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Dodo Paws and FERRONET METAL TRADE LTD will not be liable for indirect or consequential losses arising solely from use of the Site where such liability can lawfully be excluded.
However, nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms limits rights to compensation for reasonably foreseeable loss or damage where applicable consumer law provides such a right. Australian Consumer Law can provide such compensation where loss results from a failure to meet a consumer guarantee.
18. Indemnification
To the extent permitted by law, you agree to indemnify Dodo Paws and FERRONET METAL TRADE LTD against third-party claims arising directly from your unlawful use of the Services or material breach of these Terms.
This clause does not limit mandatory consumer rights.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.
The remaining provisions will continue in effect.
20. Entire Agreement
These Terms together with the policies incorporated by reference, including our:
- Privacy Policy;
- Returns & Refund Policy;
- Shipping Policy, where applicable,
constitute the agreement governing your use of the Services and purchases through Dodo Paws, subject to mandatory applicable law.
21. Assignment
You may not transfer your rights or obligations under these Terms without our prior written consent where such restriction is permitted by law.
We may transfer our rights or obligations as part of a legitimate business restructuring, sale, merger or similar transaction, subject to applicable law.
22. Governing Law
These Terms are governed by the laws of England and Wales, subject always to mandatory consumer protection laws that apply in the country or region where the customer resides.
Nothing in this section deprives a consumer of mandatory protections that cannot lawfully be waived or excluded.
For example, Australian customers retain rights available to them under the Australian Consumer Law where applicable.
23. Changes to These Terms
We may update these Terms from time to time to reflect:
- operational changes;
- changes to our Services;
- legal or regulatory requirements;
- changes to our business practices.
The current version will be published on www.dodopaws.com together with the date of the latest update.
Material changes will be communicated where required by applicable law.
